ESAC's comprehensive state regulatory compliance tools substantially reduce accredited PEOs' compliance time and costs for multi-state operations.

As PEO clients continue to expand into new states (sometimes without advance notice!) ESAC's services help accredited PEOs expedite their initial licensing / registration as well as ongoing renewals in all PEO licensing states.

What are ESAC's regulatory compliance services?

eMac state licensing service

  • ESAC's highly rated service is currently accepted by 26 of the 39 state agencies that regulate PEOs.
  • Authorized agencies access secure data already submitted as part of your PEO's accreditation process to satisfy their licensing requirements.
  • Some states exempt accredited PEOs from bonding requirements and/or offer reduced licensing fees.

eFile state licensing service 

  • ESAC assists accredited PEOs with filing requirements in states not yet accepting the eMac service.
  • Online wizards help generate pre-filled, signature-ready forms by filling data already submitted as part of your accreditation process into each PEO licensing state’s report forms.
  • Online Library provides reference data for all state licensing requirements.

Regulatory surety bond service

  • Accredited PEOs can save 50% or more on required regulatory surety bonds through ESAC's surety carrier.

  • ESAC's efficient process enables fast turn-around with no additional financial information, collateral or indemnity required.

  • Your PEO's accreditation Bond Portal contains state bonding requirements and lists your current bonds along with a report to assist with annual budgeting.

How does eMac work?

For each state agency where you want to use ESAC's eMac service, your PEO will authorize ESAC to provide secure access to required data you've already entered for your accreditation.

Based on instructions in your accreditation Licensing Portal, your PEO submits an eMac filing request and state agency filing fee payment authorization to ESAC.

ESAC reviews the filing and fee authorization for accuracy, forwards your fee and application / renewal request to the state agency, and uploads an invoice for the state's licensing fee to your accreditation Licensing Portal.

ESAC updates state licensing details within your Licensing Portal and sends weekly email notifications of application / renewal acceptance by state agencies.

ESAC provides your PEO with automatic system reminders of upcoming compliance deadlines as well as alerts regarding states where your PEO may need to initiate the licensing process.

Accredited PEOs using eMac are exempted from completing the Department of Insurance’s licensing/renewal forms and from submitting a bond and quarterly CPA verifications. Accredited PEOs also save 50% on full application/renewal fees and $500 on the addition of controlling persons.

eMac is available in Colorado! Accredited PEOs using eMac are exempted both from completing the Department of Labor and Employment’s annual report/certification forms and providing a bond.

Connecticut

eMac is available in Connecticut! Accredited PEOs using eMac are exempted both from submission of the Department of Labor’s application/renewal forms as well as client reporting responsibilities, with the Department accepting the information provided to ESAC, including the Client Assurance Program monthly upload data.

eMac is available in Florida in a limited capacity. Fully-licensed accredited PEOs using eMac are not required to submit the compliance reports required quarterly by Rule 61G7-10.001 and annually by Rule 61G7-10.0011. The application, renewal and annual assessment processes must be completed directly with the Department of Business & Professional Regulation via Florida’s online forms and can be facilitated by creating required signature-ready applications using eFile’s Form Wizard.

Accredited PEOs using eMac must upload the LA DOI Application within their eMac filing, but are exempt from completing the Department's annual renewal requirements. (NOTE: Louisiana is a dual registration state requiring PEOs to register with both the Department of Insurance and the Workforce Commission prior to providing PEO services.)

eMac is available in Maine! Accredited PEOs using eMac are exempted from completing the Department of Professional and Financial Regulations' Employee Leasing Company registration/renewal forms.

Montana

eMac is available in Montana in a limited capacity in that it may be used to fulfill the Department of Labor & Industry's financial (audited financial statements, evidence of net worth of at least $50K, and quarterly CPA verification) and bonding requirements. Accredited PEOs must submit their application/renewal forms and fees directly to the Department but required forms can be easily created via eFile’s Form Wizard.

eMac is available in Nebraska! Accredited PEOs using eMac are exempted from completing the Department of Labor's application/renewal forms and submitting a bond.

Nevada

eMac is available in Nevada! Accredited PEOs using eMac are exempted from completing the Office of the Labor Commissioner’s application/renewal forms and submitting a bond.

New Hampshire

eMac is available in New Hampshire! Accredited PEOs using eMac are exempt from completing the Department of Labor's application/renewal forms, submitting a bond and quarterly CPA verification. Also, client additions/terminations are submitted through eMac on a bimonthly basis.

New Jersey

eMac is available in New Jersey! Accredited PEOs using eMac are exempted from completing the Department of Labor and Workforce Development's registration/renewal forms, and from submitting a bond and quarterly tax certifications.

New Mexico

eMac is available in Ohio! Accredited PEOs using eMac and with workers' compensation coverage from the Ohio Bureau of Workers' Compensation (BWC) are exempted from completing the BWC’s registration/renewal forms and quarterly tax certification and from submitting a bond.

eMac is available in Oklahoma! Accredited PEOs using eMac do not have to submit a bond and are also exempt from submitting the Biographical Affidavit (Form 11) for their Responsible Persons and the Quarterly Tax Certifications. ESAC staff submits the required information on behalf of Accredited PEOs in lieu of these documents.

eMac is available in Oregon! Accredited PEOs using eMac are exempted from completing the Department of Consumer and Business Services' employee leasing certification forms and bonding.

Pennsylvania

eMac is available in Rhode Island in a limited capacity. Accredited PEOs may submit a copy of their accreditation certificate to fulfill the Department of Revenue's bonding requirement. Application/renewal forms and fees must be submitted directly to the Department; required application forms can be easily created via eFile’s Form Wizard.

eMac is available in Tennessee! Accredited PEOs using eMac are exempted from completing the Department of Licensing and Regulation's application/renewal forms, quarterly CPA verification and bonding requirement. The Department has also agreed to access eMac to view the Client Assurance Program data to fulfill their client additions/terminations requirements.

Texas

eMac is available in Texas! ESAC staff submits an abbreviated version of the Department of Licensing and Regulation's application/renewal forms for accredited PEOs using eMac in Texas, and bonding is not required.

Utah

eMac is available in Utah! In addition to not having to complete the Insurance Department’s forms, upload client add/term data to the Department, or provide a bond, accredited PEOs using eMac also save $1,000 on renewal fees.

Vermont

eMac is available in Vermont in a limited capacity. Accredited PEOs may submit a copy of their accreditation certificate to fulfill the Department of Labor's bonding requirement. Application/renewal forms and fees must be submitted directly to the Department but required forms can be easily created via eFile’s Form Wizard.

What is ESAC's regulatory surety bond program?

Accredited PEOs can save 50% or more on surety bonds required by state and federal agencies, with reduced rates of 0.5% for state regulatory bonds and 0.25% for IRS certification bonds. Bonds are provided through ESAC’s program manager, Alpha Surety, a Gallagher Company, using an A-rated U.S. treasury-listed surety carrier. 

And because ESAC’s surety carrier has already approved accredited PEOs for participation in ESAC’s Client Assurance Program, no additional financial information, collateral or indemnity is required!
